OPINION OF THE COURT BY RAMIL, J. This appeal is a consolidation of two appeals filed by the plaintiff-appellant Kamuela Price. The first appeal arises from a dismissal following a Notice of Proposed Dismissal issued by the circuit court. The second appeal arises from an order granting a motion for summary judgment, involving the adequacy of an environmental impact statement, in favor of the defendants-appellees Obayashi Hawaii Corporation and Obayashi Corporation (collectively, Obayashi) and the City and County of Honolulu (the city). For the reasons set forth below, we vacate the dismissal following the Notice of Proposed Dismissal and affirm the orders granting summary judgment in favor of Obayashi and the city and against Price.
